In the early morning hours of April 19, 2024, the Department of Education released the new “unofficial” Title IX Regulations. They are only unofficial because they've not been officially published in the Federal Register -- they are scheduled to be published on April 29, 2024.
Overwhelmed with the 1577 pages? Four tips to start:
- Digest the Preamble: First take a deep breath… you’ve got this! Read the preamble to understand the DOE's reasoning for their changes and well-crafted examples.
- Select Training Webinars Carefully: There are many providing advice. Ensure you're spending your time with the best unbiased sources. Choose trainings most beneficial for your role.
- Make Necessary Policy Edits: Definitions, scope, and jurisdiction have
changed.
- Process: The DOE gives more flexibility in process (i.e. single investigator model vs live hearings) than the 2020 regulations provided us. Gather your key campus stakeholders to audit your policies on this topic.
- Areas of Change: The most notable areas of change to focus on are:
- Sex discrimination includes discrimination based on sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation and gender identity.
- Retaliation and peer retaliation are defined.
- Protections for pregnancy and related conditions - which includes students, employees and applicants.
